1. Definitions and Interpretations

• "Student": A fully registered user who has successfully enrolled in one or more academic courses.
• "Course": Premium online training programs, cohorts, and educational content modules provided by EVCSM Skills.
• "Content": All instructional materials, video matrices, PDF documents, quizzes, codebase assignments, and certifications.

2. Eligibility & Registration

Who Can Use Our Platform:

• You must be at least 18 years of chronological age to form a binding contract.
• You must be a resident of India (exceptions apply strictly for explicitly stated international programs).
• You are solely responsible for the absolute accuracy of data provided during the registration sequence.
• You must provide valid Government KYC documents (e.g., Aadhaar, PAN) when officially requested for credential verification.

Account Responsibilities:

• You are mandated to maintain strict confidentiality of your cryptographic login credentials.
• You agree to be held fully accountable for all structural activities executed under your account node.
• You must immediately inform our support cell of any suspected unauthorized account breaches.
• You must never share, sell, or rent your account access to unauthorized third parties.

3. Course Enrollment & Access

Enrollment Terms:

• Enrollment serves as a definitive confirmation of your intent to complete the required modules and pay the specified fee.
• Course fee payments are strictly non-refundable as detailed in our dedicated Refund Policy.
• Upon successful payment gateway confirmation, you gain immediate access to the respective course materials.
• Access authorization remains active and valid for the lifetime of the purchased course.

Course Delivery:

• Programs are delivered completely online via our proprietary Learning Management System (LMS).
• You are required to maintain a stable, high-speed internet connection to consume high-resolution course feeds.
• We accept no liability for technical bottlenecks or hardware issues originating from your end.
• Course content, release schedules, and designated mentors are subject to strategic changes at our discretion to maintain industry relevance.

4. Intellectual Property Rights

Content Ownership:

• All course content, video feeds, structural notes, code assignments, and proprietary materials are the exclusive intellectual property of EVCSM Skills.
• You are granted a highly limited, non-exclusive, non-transferable license to consume the content for personal educational objectives only.
• You may not record, reproduce, distribute, modify, or republish any component of the course content.
• Unauthorized extraction or piracy of our intellectual property will result in immediate, severe legal action.

User-Generated Content:

• Any assignments, codebase projects, or original content you submit during the course remain your intellectual property.
• However, we retain a perpetual right to utilize your submissions for platform educational and promotional demonstrations with proper attribution.

5. Academic Integrity & Malpractice

Student Conduct:

• You must uphold absolute academic integrity during all portal assessments and final exams.
• Cheating, script-kidding, plagiarism, or utilizing unauthorized secondary materials is strictly prohibited.
• You must never distribute or leak exam algorithms or answers to unauthorized individuals.

Proctoring & Monitoring:

• We reserve full rights to execute automated AI and manual proctoring protocols during exams.
• Screen recording telemetry, camera access, and microphone monitoring may be deployed to enforce examination integrity.
• Malpractice detected during proctoring routines will result in instant failure of the exam and potential course lock-out.
• Zero refunds are issued in scenarios of confirmed academic malpractice.

Consequences of Violation:

• First violation: Immediate exam suspension, resulting in an automatic failing grade.
• Repeated violations: Permanent course cancellation and account termination without any fee refund.
• Corporate legal action may be pursued if platform security is compromised.

6. Certification & Credentials

Certificate Issuance:

• Official certificates are cryptographically generated only after 100% course completion and successfully passing all required assessment gates.
• Certificates are secured by unique verification hashes and can be validated publicly on our website by employers.
• Certificates align with the standards of recognized government bodies (e.g., NSDC, Skill India) where applicable.

Misuse of Certificates:

• You must never digitally forge, Photoshop, alter, or misrepresent your certification status.
• False representation of your technical credentials constitutes fraud and may result in legal consequences.
• We reserve the unconditional right to instantly revoke and invalidate certificates if any violations are detected post-issuance.

7. User Conduct & Acceptable Use

Prohibited Activities:

While operating within the EVCSM Skills ecosystem, you explicitly agree not to:

• Execute harassment, bullying, or abusive behavior towards other community peers or our technical staff.
• Post or transmit obscene, highly offensive, or discriminatory content in community forums.
• Attempt to penetration test, hack, breach, or maliciously compromise the security architecture of our platform.
• Utilize the platform for unauthorized commercial campaigns or third-party business activities.
• Attempt to scrape, resell, redistribute, or repurpose any of the core course content.
• Violate any applicable local, state, or international cyber laws and regulations.

8. Payment Terms

Payment Methods:

• We accept secure transactions via credit cards, debit cards, net banking, and verified digital UPI wallets.
• All financial transactions and pricing models are processed strictly in Indian Rupees (INR).
• Payment processing is routed through highly secure, authorized, RBI-compliant third-party gateways.

Payment Obligations:

• You assume full responsibility for all financial charges incurred under your account.
• If utilizing an EMI/Installment plan, payments must be executed successfully as per the agreed schedule.
• Course access will be temporarily suspended if installment payments are marked overdue.
• Applicable government taxes and GST (18%) are calculated and added to the final course fee.

9. Disclaimer & Limitation of Liability

Platform "As Is":

• The EVCSM Skills Platform is provided strictly on an "as is" and "as available" basis without any warranties or guarantees, express or implied.
• We do not guarantee 100% uninterrupted, bug-free, or zero-latency service operations.
• We are shielded from liability regarding technical network failures, ISP outages, or localized data loss.

No Guarantee of Employment:

• While our programs are highly optimized, course completion does not guarantee absolute job placement or an immediate salary spike.
• Professional employment outcomes depend heavily on your individual effort, technical execution, and macroeconomic market variables.
• We provide premium placement pipelines and support, but final hiring authority resides solely with the corporate employers.

Limitation of Damages:

• In any legal scenario, EVCSM Skills' maximum liability is strictly limited to the exact amount of fees paid by you for the specific service in dispute.
• We accept zero liability for indirect, incidental, punitive, or consequential financial damages.

10. Suspension & Termination

Account Suspension:

We retain the authority to temporarily freeze your account access if:

• You systematically violate these agreed Terms and Conditions.
• Malpractice, academic dishonesty, or code plagiarism is flagged by our systems.
• A scheduled payment fails or remains overdue beyond the grace period.
• Threatening, highly disruptive, or abusive behavior is reported to our administration.

Account Termination:

• We reserve the unconditional right to permanently terminate your account at any time for severe cause.
• Upon permanent termination, you instantly lose all access to purchased courses and historical materials.
• Zero financial refund is provisioned upon a breach-induced account termination.

11. Data Privacy & Protection

• Your personal and telemetry data is rigorously protected as per our extensive Privacy Policy architecture.
• Our operational data handling complies strictly with the Digital Personal Data Protection (DPDP) Act of India.
• We will never share your dataset with unauthorized third parties without explicit consent, except when compelled by legal enforcement.
• By utilizing the platform, you acknowledge and accept our data collection, encryption, and usage practices.

12. Third-Party Links & Services

• Our digital platform may contain routed links to third-party web environments and external services (e.g., GitHub, Figma, Vercel).
• We hold zero responsibility for external third-party content, their privacy practices, or their specific terms of service.
• Interaction with and use of any third-party tools or services is executed entirely at your own risk.
• We highly recommend reviewing their operational policies before authorizing access or usage.

13. Dispute Resolution & Grievance Redressal

Grievance Process:

2. Our response team will acknowledge and analyze the issue within 5-7 business days.
3. A dedicated grievance officer will investigate the logs and propose a fair resolution.
4. If the proposed resolution is unsatisfactory, the ticket may be escalated to upper management.

Governing Law & Jurisdiction:

• These Terms are constructed and governed exclusively by the jurisdictional laws of India.
• Any formal legal disputes or claims will be resolved strictly in the designated courts of Kota, Rajasthan.
• Both parties legally agree to submit to the exclusive jurisdiction of these specific courts.

14. Amendments to Terms

• EVCSM Skills reserves the absolute right to modify, upgrade, or amend these Terms at any time without prior explicit permission.
• Critical changes to the legal structure will be communicated via registered email or a priority dashboard notification.
• Your continued utilization of the platform post-amendment constitutes full legal acceptance of the updated Terms.
